Terms of Service

These Terms of Service ("Terms") govern your access to and use of FanMagic ("the Service"), a software tool that helps creators automate Telegram conversations using AI. By creating an account you agree to these Terms and to our Acceptable Use Policy.

1. Eligibility

You must be at least 18 years old and legally able to enter into contracts to use the Service. The Service is intended only for legal, consenting adult creator businesses.

2. The Service

FanMagic is a SaaS automation tool. It provides software that helps users manage AI-assisted Telegram conversations. FanMagic is not a party to any transaction between you and your fans or customers. In this version, FanMagic does not:

  • sell your content;
  • process fan payments;
  • host paid PPV content;
  • deliver paid content to fans;
  • verify, endorse, or guarantee external offers or links;
  • act as a party to transactions between users and fans;
  • control what users sell through their own external links.

2a. Who can use FanMagic

FanMagic may be used by any adult creator or operator — including individual creators, agencies, and operators running a stage persona, fictional character, or brand character. You must own or have the rights to every persona, name, image, voice, link, and asset you use, and you may not impersonate a real person without authorization.

3. Credits

  • Credits are prepaid and consumed as described on our Pricing page.
  • One credit corresponds to one bounded AI conversation with one unique fan.
  • Credits are non-transferable. Purchased credits are generally non-refundable except where required by law.

4. Your responsibilities

You are solely responsible for:

  • your personas and characters;
  • your content and uploaded assets;
  • your external paid links and offers;
  • your conversations and your fan/customer relationships;
  • your compliance with all applicable laws and your taxes;
  • compliance with the terms of any third-party platform you use or link to;
  • obtaining all required rights and consents for the persona, names, images, and voice you use;
  • ensuring that all persons and content involved are legal, consenting adults.

5. AI-generated content

Conversations are generated by third-party AI providers and may be imperfect. You are responsible for reviewing and supervising AI behavior, and you can pause or take over any conversation at any time.

6. Suspension and termination

FanMagic reserves the right to suspend, restrict, or terminate accounts that violate these Terms, the Acceptable Use Policy, applicable law, payment-provider requirements, or platform safety rules. We may also act against illegal, harmful, abusive, or policy-violating use.

7. Disclaimers and liability

The Service is provided "as is" without warranties of any kind. Because FanMagic is a software tool and not a party to your transactions, you use it at your own responsibility as described in section 4. This does not exclude liability that cannot be excluded under applicable law. To the maximum extent permitted by law, FanMagic is not liable for indirect or consequential damages arising from your use of the Service or from your dealings with fans or third parties.

8. Changes

We may update these Terms from time to time. Continued use constitutes acceptance.
